The following Conditions and Regulations apply to your purchase of MyClass in Poland. These terms apply in addition to, and take precedence over, our International MyClass Terms and Conditions of Sale which you should also review before purchasing this course.


CONDITIONS AND REGULATIONS IN POLAND

Definitions

British Council means Fundacja British Council registered in the District Court of Warsaw, XII Commercial Division of the National Court Register under KRS number 0000449621, NIP (tax Identity No.): 7010369489, with its registered office in Warsaw, Poland and address at 54 Koszykowa, 00-675 Warsaw, Poland

Participant means a person intending to purchase a Credit Package.

MyClass means a British Council product for Adult students learning English and described on the MyClass course page on the website.

The Payment Processor means the British Council’s third-party payment gateway provider for MyClass.

Credit package means a package of Class Credits which can be purchased based on the offer on our timetable and pricing page on the website.

The Purpose of processing is:
The performance of the contract for the enrolment and participation in an English course, learning about health or medical conditions that have or may have influence on the learning process, running a satisfaction survey and quality assessment of our services, fulfilling the Controller’s legal duties, marketing, promotion and sale of services, possible determination, settlement and/or defence of any claims, video monitoring, for internal administrative purposes.

Your rights:
You have the right to access the content of the data provided to us, to correct them, to request their deletion or to restrict their processing, the right to object to the processing, the right to transfer the data, the right to request access to the data, and also the right to submit a complaint to the supervisory body.

The British Council uses a Payment Processor to facilitate your payments in respect of MyClass. To allow our Payment Processor to verify and process your payments, it is necessary to provide certain personal information to the Payment Processor (including your name, financial details, and billing address and telephone number). When you purchase a Credit Package, payments by credit or debit card are processed immediately via the Payment Processor over a secure link. No card details are held by the British Council. Our Payment Processor will only use your personal information for the purpose of processing payments and in accordance with applicable data protection laws.

Payment for the course – in-person registration

The payment shall be made via a bank transfer to the British Council bank account number at Bank Handlowy S.A. VI O/W-wa:

or in person by a credit card at the British Council office. The date of payment is the date on which the bank debits the Participant’s bank account.

The course fee must be paid by the date agreed during registration. Access to the student portal and credit package are granted after settling a payment in full or a first agreed instalment. In the case of instalment payments, the Participant receives the corresponding proportion of credits from the total number in the package. Failure to meet the deadline for payment of any of the instalments will result in the removal of access to the platform.

For courses with a set course book or magazine, a copy will be provided. Please note that there are some courses which do not have a set course book.

Payment for the course – online registration

The MyClass website will guide the Participant through the steps to purchase a credit package. Payment can be made by credit or debit card, or e-wallet (or any other payment method indicated in the order process). In all cases British Council considers successful payment as confirmation that the Participant is the person authorised to use that credit card or debit card or other payment process and that the Participant is over the age of 18 years.

Once the Payment Processor receives a legitimate payment for a credit package, the Participant will receive an order confirmation by email, which confirms British Council’s acceptance of the order. Access to Class credits will be granted immediately after the purchase and receipt of the order confirmation. The Participant will receive a contract with this document of Conditions and Regulations within 2 working days from the date of purchase. By making a payment at the online registration stage, the Participant will be deemed to have read and accepted Conditions and Regulations.

For courses with a set course book or magazine, a copy will be provided. Please note that there are some courses which do not have a set course book.

Invoice

The British Council issues an electronic invoice for the payment made only at the customer's request. The request may be submitted within 3 months from the date of payment. The invoice will be sent via e-mail by the 15th day of the next month.

Duration of the course

The course duration shall be indicated in the order confirmation and in the contract delivered by email within 2 days from the date of purchase of a credit package.

Credits

One credit in British Council courses for Adults is a 90-minute lesson, however this does not apply to special activities such as MyOne-to-One session, MyClub, MyAdvisory, MyOrientation and other. In-person classes (and online, if offered), which can be studied individually or as part of a module, and booster classes consume 1 credit per lesson from your package, MyOne-to-one 4 credits per lesson. Other special activities e.g. MyClub, MyAdvisory, MyOrientation are free of charge.

Class cancellation

A Participant can cancel a reserved lesson. If a Participant cancels a class at least 24 hours before the start of class, the credit will be refunded and can be used again. If a Participant cancels a class less than 24 hours in advance, the credit will not be refunded. The Participant is not entitled to re-use the credit at a different date or to request a refund for the cancelled class. In the event the Participant cancels a module, only the credits for classes taking place more than 24 hours after the cancellation will be refunded.

Cancellation and refund

Cancellation of a course by the Participant can only be granted if requested in writing within the validity period of the package. In the event of cancellation within 14 days from receiving the Order Confirmation, the Participant is entitled to receive a full refund of all payments to the British Council for the credit package except in the case where at least one credit has already been used, in which case the amount of the refund will be reduced by the cost of the classes taken.

In event of the cancellation of a course by the Participant after the expiry of the 14-day period, a refund is calculated according to the number of credits remaining until the end of the course and a 10% administration fee of the total course fee will be charged in such cases. If the account expires, no refund is given.

Account suspension

Suspension of the account can only be granted if requested in writing within the validity period of the package. The Participant may suspend participation of the course for a period of 6 months within one package, with the total number of suspensions not exceeding 3. After the suspension period expires, the Participant regains access to the course for the remaining period at the time of suspension.

Account extension

The Participant may apply for a free extension of the account's validity, if during the course there was a period of suspension of classes by the British Council (no longer than the period of suspension). In addition, if the credits are not used within the duration of the package, the Participant may apply once for a two-week free extension of the account.

Unused credits

Unused credits can be renewed within a maximum of 6 months from the end of the package's validity by purchasing a monthly extension package or by purchasing another package. A maximum of 10 credits may be transferred to a new package and they may be used for the entire duration of the new package, with the proviso that in the event of cancellation the transferred credits are not refundable in full, and the credits used from the beginning of the new package will be settled under the current package.

Change of a course and level

In the event of a customer choosing to change to a course with a lower fee, an administration fee equivalent to the difference in fees of the two courses will be charged. Should a customer change to a longer course with a higher fee, then the difference in fees must be paid. A change of level is possible after obtaining the teacher’s consent.

Change in MyClass offer

The British Council reserves the right to modify the range of available classes and activities during the year. In this event, if the Participant is no longer able to attend, the Participant has the right to terminate the agreement and request a pro-rata refund of the value of unused credits without a deduction of an administration fee.

Special circumstances

The British Council reserves the right to cancel classes in the event of exceptional, unforeseen and special circumstances (e.g. natural disasters, national events etc). The British Council will make every effort to ensure that the classes are carried out on a different date but is not able to guarantee this. If it is not possible to conduct classes in person, lessons can also be conducted online.

Statement of attendance

A Statement of Attendance is issued at the request of the Participant on completion of a package indicating the number of hours completed in a course.

Fundacja British Council delivers its educational programme through non-public educational institutions: British Council Centre for adults and British Council Centre for children and teenagers.
